[ Companies Act Sec. 49 in Hindi ] –
शेयर धारको के अधिकारों में फेरफार –
जहां किसी वर्ग के शेयरों के संबंध में और शेयर पूंजी के लिए कोई मांग की जाती है, वहां ऐसी मांगें उस वर्ग के अधीन आने वाले सभी शेयरों के संबंध में एक समान आधार पर की जाएंगी ।।
स्पष्टीकरण-इस धारा के प्रयोजनों के लिए, समान अभिहित मूल्य के शेयरों को, जिन पर विभिन्न रकमें समादत्त की गई हैं, एक ही वर्ग के अधीन आने वाला नहीं समझा जाएगा ।
कंपनी अधिनियम धारा 49
[ Companies Act Section 49 in English ] –
“ Calls on shares of same class to be made on uniform basis”–
Where any calls for further share capital are made on the shares of a class, such calls shall be made on a uniform basis on all shares falling under that class.
Explanation.—For the purposes of this section, shares of the same nominal value on which different amounts have been paid-up shall not be deemed to fall under the same class.
